Please note:
We are no longer able to claim for any damage to items if a parcel has been signed  for "in good condition".
Any damage to the exterior of the box must (without exception) be noted before signing for the parcel.
All claims for damage must be made within 48hours of receiving the items and must include photos showing the items and any damage to the exterior of the box.

Terms & Conditions

1. These general conditions of sale govern all relations between Rik Newell for La Deuxième Chance which is located at 7 rue de la Croix Cholette, 79120, Le Bois de Messé, France
 Siret number: 4991021350039 and its customers.
These conditions of sale are systematically brought to the attention of each purchaser downloading the order form.
Accordingly, the fact of placing an order implies full and unreserved agreement to these general terms and conditions to the exclusion of any other document,
such as brochures, catalogs issued by the seller, which only have an indicative value.
Any contrary condition by the purchaser will, in the absence of express acceptance, will be deemed unenforceable to the seller regardless of when it may have been brought to its attention.
The fact that the seller does not prevail at a given time of any of these terms of sale, can not be interpreted as a waiver to subsequently invoke any of those conditions.
These general conditions can be modified at any time and without notice by "Rik Newell, La Deuxième Chance", the changes are applicable to all subsequent orders to this change.
The photographs illustrating the products are for guidance and are not contractual. If errors occur, in no event willl "Rik Newell or La Deuxième Chance " be liable.

2. "Rik Newell & La Deuxième Chance" must respect the legal guarantee against hidden defects within the meaning of Article 1641 of the Civil Code which provides that "the seller is
is given a guarantee against hidden defects that may render items unfit for use for which it was intended, or that decrease this use so that the purchaser would not have acquired them, or would have paid a lower price if he had known. "
The information collected on this website will not be subject to any external communication as the only administrative need to meet the legal and regulatory obligations.

3.  "Rik Newell for La Deuxième Chance" will confirm the acceptance of any order by any of the following: email, phone, or sms.
However, orders should not be taken as the definitive date of receipt of payment or the debit from the purchaser's account when using a bank card or bank transfer.

4. All product returns must be  formally agreed between the seller and the buyer.
Any return accepted by the seller, in the case of an apparent defect or nonconformity of the delivered products, which will be recognized by the seller, will entitle the buyer to a replacement, credit note or refund, excluding any other compensation or damages. The product should be returned to the buyer in original packaging and within 48 hours of receipt. All colour choices are final.

5. All products are supplied at prices prevailing at the time of placing the order.
The price mentioned on the order form is understood to be  excluding taxes. TVA is not applicable, according to Article 293B of the CGI.
For deliveries outside of mainland France the price does not include taxes in the destination country.
Shipping costs are charged  according to the tariff quoted on the order form. They include packaging, and are calculated according to weight accumulated for each item.
Under the law of 12 May 1980, "Rik Newell of La Deuxième Chance" retains ownership of the product until full payment by the customer.

6.  The price of items ordered is payable in full to "Richard Newell of La Deuxième Chance" on issue of your order on the website
 
according to one of the following payment methods:
- by credit card or bank transfer.
We have set up for you a secure payment via Braintree Payments. This procedure uses the latest encryption technology,
 
the reference for secure payment.
"Rik Newell or La Deuxième Chance "declines any responsibility in any form whatsoever and is not responsible for any stakeholder disputes between the buyer and Braintree Payments.
Transportation costs shown are valid for metropolitan France. For other destinations, contact us. Annie Sloan products are not
sold outside of France métropolinaine.

7. As provided by Article L121-16 of the Consumer Code and under the distance selling act, the buyer has a 7 day cooling off period
 from the date of receipt of the merchandise to be refunded against the products delivered under the following conditions:
  The buyer is obliged to return the items within 7 days receipt of the parcel by the buyer (the date of  delivery is the  date of the signature collected by colissimo)
 
The goods must be in their original condition, packaging and unopened. After this time, no returns will be accepted and no refund will be made.
The return of goods is at the expense and risk of the buyer.

8. Claims or disputes will always be received with our full attention and good faith.
This contract is subject to French law. "Richard Newell or La Deuxième Chance" can not be held liable for damages of any kind, whether tangible or intangible or injury that could result from a malfunction or improper use of products sold. This applies to any changes resulting from product manufacturers. The responsibility of "Richard Newell for La Deuxième Chance " will in any event, limited to the amount of the order and cannot be blamed for simple errors or omissions that may occur despite all precautions taken in presenting the products. In case of dispute, the customer will conduct its claims to the buyer's customer service.
Otherwise, the French courts including the tribune de Libourne should be consulted.

9. All Items sent within France are made via Colissimo.
Shipments outside of France are possible on request with the  exception of Annie Sloan products which are sold exclusively in France.

Tva is not applicable, section 293 B of the CGI
For deliveries abroad, customs fees, taxes of all kinds may be requested upon delivery which do not appear in our total price.

Deliveries are made in France, and are normally dispatched within 72 hours of receiving payment .
Packages are shipped by Colissomo. Items weighing more than 0.75kg including packing will require a signature
The information stated by the buyer, when placing an order is considered to be correct. If in the event of an error in the recipient's details (including name, number and street name, postal code, city name, phone number or email address), the seller can not be held responsible for any  failure to deliver the product correctly.
All re-delivery, if applicable, will be charged to the customer.
Delivery times are listed as accurately as possible in the order confirmation sent to the customer by email which will include a link to track the progress of your item(s)
Delays in delivery times may give rise to damages.
However, if 5 weeks after the stated delivery date, the product has not been delivered for any reason other than "force majeure", the sale may be canceled
 
and the purchaser obtain a refund of the price of the goods with the exclusion of any other compensation or damages.
The following are considered to be "force majeure" releasing the seller from its obligation to deliver, natural disasters, administrative decisions, transport strikes, war, riot, fire, strikes (including postal strike), accidents and the impossibility of being supplied.
The seller will keep the buyer informed of any cases or events listed above.

10. On receiving the goods, the buyer must immediately check their condition and their compliance with the order. In the event of the package being damaged, the buyer must note this when signing for it. Claims for damages should be made by email within 48 hours of receipt of the goods. All claims relating to an inaccuracy in the amounts or receiving incorrect items in relation to the accepted offer or confirmation of the order by the seller, must be made in writing or by email within 48 hours of receipt of goods, otherwise the right to claim will not be possible. Photographic evidence of damage to goods maybe required.  Claims will not be considered if an item has been signed for and accepted as being in good condition. Any damage to parcels must be noted upon delivery.

11. By connecting to the website created by "Rik Newell for La Deuxième Chance" you are acknowledging him as the holder of all intellectual property rights therein, the client agrees not to copy or download all or part of its content without the prior express authorisation of "Rik Newell for La Deuxième Chance".
As provided by Article L121-16 of the Consumer Code and related acts, the customer agrees not to copy or download all or part of its content unless specifically authorised by "Rik Newell of La Deuxième Chance."

12.We will not be held responsible for any errors in descriptions or pricing on the website. We recommend that clients contact us directly if they are unsure of any information provided. We reserve the right to reject or amend an order in the event of a mistake and will inform clients immediately by email of any amendment.  Orders are not considered final until they have been dispatched by us.

20. Once items have been dispatched by us we are unable to offer a refund for postage paid. This is without exception.

21. All goods remain the property of the seller until payment in full has been recieved. We reserve the right to add a late payment fee to invoices that are still outstanding despite reminders. Reminders may be sent by email or recorded delivery. In the event  of non payment legal action to recouperate the outstanding debt will be taken. All costs involved in any legal action or debt recovery will, without exception, be sought from the debtor. Late payment fees are calcuated using the current rate of interest notifed by the EBC. This will be miltiplied by a factor of 3 taking into account the period of time that the debt has been outstanding.
